EXHIBIT A
WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

intending to be legally bound hereby, the undersigned Guests/Resident and my/our heirs, and executors, invitees, family and friends staying with me/us, do hereby voluntarily agree to fully release from legal liability and to indemnify, remise and hold harmless the Westmore Beach Villas Ltd., its owners, operators, directors and any of its employees or agents representing or related to the Westmore Beach Villas Ltd., and the property owners of the Westmore Beach Ltd. Facilities, for any financial damages, claims, causes of action including food allergies and COVID-19 infection resulting from the use of the facilities, services, equipment ,accommodations, and travel to or from the facilities at Westmore Beach Villas, Ltd.
I agree that this release and indemnification consent is for any and all liability, claims, damages, judgements for personal injuries including death ,property losses, damages occasioned by or in connection with any activity, excursions, services or accommodations at or arranged by Westmore Beach Villas, Ltd.
The undersigned takes full and complete responsibility for my/our safety and agrees to abide by the local laws and requirements promulgated by the Westmore Beach Villas, Ltd., and to adhere to directions provided by staff and employees, including the prevention and spread of the COVID-19 virus infection. I further acknowledge that transportation providers, their vehicles, excursion operators and restaurant facilities and their personnelare not employees, agents or the responsibility of Westmore Beach Villas, Ltd., and are used at my own risk.
I also acknowledge, understand and agree that the beach facilities are public, and are not owned, operated or maintained by Westmore Beach Villas, Ltd., and are used at my own risk; and further that there are no life guards or safety equipment present.
This consent agreement and release of liability is voluntary, have been fully explained to me and are for all purposes governed, construed and adjudicated in accordance with the laws of Jamaica.

EXHIBIT B                                                                  HOUSE RULES                                      WESTMORE BEACH VILLAS LIMITED (VILLA)

Resident/Guest acknowledges that the rented facilities are a part of a Villa community consisting of several other occupants and guests. Resident and his/her family and guests agree to abide by all local laws and the following rules,regulations, and conditions and not to cause any disruptive activity and noise on the premises which may disturb the peace and quiet of another Guest or Neighbor.
1. Resident/Guest acknowledges that the rented/leased property is part of a Villa community with short term guests and other residents. Resident further acknowledges that the property/facilities abut a public beach, the use of which is not part of the rented property and if used by resident, family or friends is done at his/her own volition and risk. Life Guards and other safety equipment are not present at the beach nor are they the responsibility of Westmore Beach Villas Limited.
2. The Facility and grounds are non-smoking. The use of tobacco products, e-cigarettes and cannabis (marijuana, pot, and ganja) are prohibited. If anyone smokes in the unit a minimum cleaning fee of US $250 will be assessed plus any damages.
3. Pets are not allowed. Resident should not feed or handle any stray cats, dogs or other animals.
4. Westmore Beach Villas Limited is not responsible for the damage, loss or theft of any item or for items left in the facility after guest/ resident departure.
5. There is no electrical “under sink” garbage disposal equipment in the kitchens. Food material, cooking oil, or other solid items must not be placed into the drains. The sink strainer provided must be positioned in the sink drain at all times and used to collect any food material.
6. The refrigerator, stove, microwave and cabinets must be kept clean and emptied of all food and condiments on departure.
7. All trash and garbage must be properly placed in the provided receptacles.
8. All television and air conditioner remotes, surge protectors, and keys are to be returned on departure.
9. A maximum of one car per unit is permitted on the property as space is available, and determined by Management.
10. The Villa Facility is to be maintained in a clean and safe manner preventing the formation of mold or the infestation of household pests.
11. Follow the directions provided by staff particularly in case of Emergency.
12. The furnishings, electronic equipment, supplies and other service items are provided for your enjoyment. Care and safety should be exercised in their use in order to prevent loss damage and breakage which will be charged to you.
13. Residents/ Guests with children are fully responsible for the care, supervision and safety of their children at all times. Child care services are not provided. Villas are not “child proof”, the drawers and cabinets are not locked and electrical outlets are not covered.
14. Common area furnishings and equipment are provided for your enjoyment and should be safely utilized.
15. All laundry is to be completed indoors; no hanging of clothes on the rails or building.

Swimming Pool Waiver and Liability Release Form

PLEASE READ CAREFULLY THE CONTENTS OF THIS FORM BEFORE SIGNING.

In consideration for being allowed to use the swimming pool and other facilities, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged:
I/We understand and agree that during our stay, I/we shall be responsible for our children, guests and any relatives using the pool.
I/We understand and agree that there are risks involved in the use of the pool facilities such as injury or death.
The following persons are my children, guests and/relatives who shall be under my care:

Further, I/We hereby acknowledge and declare that:
I/We agree to indemnify, release, and hold harmless the Westmore Beach Villas Limited, its owners, directors,management, employees, agents and property owners from any cost, liability, claim, damages, demand arising from injury, loss, illness, or death to me, my immediate family, guests, invitees related to the use of the pool.
Likewise, any damage or loss to personal property caused by or related to the use of the Swimming Pool, its facilities, and its use.
Finally, I/we recognize and fully understand, acknowledge and agree with the information above. By signing this form, I/we expressly declare that I/we are of legal age and that I/we are aware of the full contents of this waiver and release of liability and I/we are legally accountable to any and all effects of this Release.
